Zouhaier Chihaoui


Zouhaier Chihaoui was born in Ghent on 14 January 1983. He grew up in an underprivileged area of Ghent (Calles New Ghent) and this gave him a sense of justice and an intense desire to see society evolving to become a community of equal chances. So his choice for Human Rights came naturally. He graduated in law at the VUB, the Free University of Brussels, in 2006 and did his lawyeras training with Christophe Marchand, his supervisor and mentor, with whom he now shares his office (Juscogens). For Zouhaier Chihaoui defending the Human Rights is not just a task, it is a social duty that he cherishes, with his utopian idea that the States have to respect the Human Rights of all, rich or poor, black or white, small or big, young or old, so that they would have the opportunity to develop in a society worth being called a Constitutional State. In his second year as a lawyer trainee he defended his first case in the ECHR, Grand Chamber a M.S.S. vs. Belgium, Greece 21-01-2011, and the Courtas decision he obtained forever changed the application of article 3 of the ECHR and the blind application of the principle of legitimate expectation between Member States of the Council of Europe. Today he is worthy of the name of Human Rights lawyer, having obtained a record of sentences against States. His knowledge of the law and human rights as well as his mathematically logic approach grant him the capacity to offer a solution even in the most complex cases.
