Why A Virtual Office?

Just Rights – currently based in Brussels and among the first to be exclusively specialized in the field of human rights – has a vocation to extend its reach to the European level. For this reason, Just Rights has set up a virtual platform in order to make its services more accessible to individuals residing in other countries which are member States of the Council of Europe.

Legal advice from a specialist prior to a direct petition to the European Court of Human Rights can often prove particularly useful as it will allow you to avoid frustration as well as loss of time and money.

The creation of the virtual office of Just Rights was prompted by the worrying observation of the lack of European lawyers specialized in the field of human rights, often having a direct impact on the success or failure of cases brought to the European Court. Presently 95% of the appeals lodged with the European Court of Human Rights are rejected before being examined on the merits solely because of the failure to comply with the admissibility criteria laid down by the European Convention on Human Rights.

According to the Council of Europe, experience and statistics show that not only most individuals bringing an appeal to the European Court of Human Rights, but also many legal advisers and lawyers, lack sufficient expertise regarding the admissibility requirements for a case to be considered by the Court.

To avoid this, a preliminary check of the case is crucial. The Just Rights virtual office offers you the possibility to solicit and obtain, at short notice, a specialized opinion on the admissibility of your case in light of the conditions imposed by the European Convention on Human Rights. This is not only in the interests of the victim but it is also in the interest of good justice.

Areas of Intervention

Just Rights offers its services in the following areas:

  • Preliminary stage: We will provide a reasoned opinion on the admissibility of your case to the European Court of Human Rights.

  • If your case is found to be admissible: We will draft an individual application under Article 34 of the European Convention on Human Rights and conduct a follow-up of the case before the European Court of Human Rights.

Initially, the services offered by the virtual office of Just Rights are limited to the audit of the admissibility of your case. In the event of a positive opinion and you wish that your case will be defended by our firm, Just Rights will do the appeal to the European Court of Human Rights in accordance with Article 34 of the Convention.

Conditions of Intervention

  • Country. At the moment, the intervention of Just Rights is limited to cases concerning the following countries: Belgium, France, the Netherlands, Luxembourg, Switzerland, Spain, United Kingdom and Italy.

  • Stage of the case. Just Rights will only examine those cases where national proceedings have been pursued up to the highest judicial body and therefore where there is no possibility of recourse remaining at national level. If this is not the case, it may be necessary to explain why, in your particular case, not all available domestic remedies have been exhausted.

  • Financial conditions. The base price for an opinion on the admissibility of your case is €500. In the event that the case is more complex, Just Rights reserves the right to present you with an alternative price, with reasons justifying such higher price, which can never exceed €1,000.

  • Time-limits. Just Rights undertakes to give you a reasoned opinion on admissibility within ten (10) days. In the event of an emergency, and subject to financial conditions to be agreed upon, a notice may be provided to you within 48 hours.

Procedure For Obtaining An Opinion

If you wish to obtain a reasoned opinion from Just Rights on the admissibility of your case to the European Court of Human Rights, please follow the instructions listed below:

  1. Fill out your contact information in the application form below.

  1. Upload the necessary documents in the application form, i.e. the pleadings of your case: the judgments of the national courts and the submissions / pleadings filed by your lawyer in these proceedings.

  1. Upon receipt of your request and all relevant documents, Just Rights will send you an email inviting you to pay the fees, in accordance with the financial conditions as described above.

  1. Upon receipt of your payment, Just Rights will send you a reasoned opinion on the admissibility of your case, in accordance with the timeline as described above.
